FCC Report: Media Needs to Serve Somebody

There was big news in the world of journalism yesterday (for those who follow such things and/or care what the Federal Communications Commission has to say) when the FCC released a 470-page report on the state of the U.S. media. In summary, their conclusion wasn’t exactly a positive one, with the overall finding seeming to be that American media isn’t serving the public. What’s most interesting — or perhaps most telling — is that the Democratic and Republican commissioners seemed to have two entirely different takes on the report. Imagine that. National Journal reports

Federal regulations designed to ensure that broadcasters serve the public interest are broken, allowing stations to dump local-news reporting and lowering standards for news ranging from international developments to government scandals, the Federal Communications Commission said on Thursday.

"Over time, court rulings, constitutional concerns, and FCC decisions have left a system that is unclear and ineffective,” the agency said in a long-awaited report on the U.S. media. “The current system operates neither as a free market nor as an effectively regulated one; and it does not achieve the public-interest goals set out by Congress or the FCC.”

The 470-page study turns the tables, with the FCC reporting on media outlets that usually are the ones doing the reporting.

To promote public-interest programming on public airwaves, the report recommends more disclosure from broadcasters. It also calls for C-SPAN-like public-affairs networks in each state.

Too often, the report asserts, the FCC rubber-stamps broadcast licenses without ensuring that the outlets involved cover the local community.

Further, the proliferation of Internet-based news outlets has not improved the quality of journalism, the researchers found.

“It turns out you can have an abundance of media outlets and a shortage of real news,” said the report’s lead author, former journalist Steven Waldman. At the root of the growing dearth of quality reporting, he concluded, is the fact that advertising is increasingly disconnected from content.

“If ad rates were the same online as they are in print, we wouldn’t be having this conversation,” Waldman said. In a first for the agency, the report urges lawmakers to consider the “positive benefits” of online tracking when drafting privacy legislation. Such tracking, the report states, offers a possible way for news websites to attract more ad revenue.

To help strengthen the public service potential of media, the report makes six broad recommendations: emphasize online disclosure as a pillar of FCC media policy; make it easier for citizens to monitor government by putting more information online; consider directing more existing government spending to local media; foster an environment for nonprofit media outlets to succeed; promote broadband access; and ensure that media policy helps historically underserved communities.

The highly anticipated report didn’t go far enough for Democratic FCC Commissioner Michael Copps, who has long called for tighter public-interest regulations.

“Enlightened policy that promotes the public interest is basically glossed over by the staff report as having been tried and failed,” Copps said at Thursday’s commission meeting, where the findings were presented.

He took the report’s authors to task for “tinkering around the edges” by not calling for major overhauls. “In the recommendations, there is some hedging about whether all that consolidation we are living with today—all these local, independent stations bought up by mega-media interests—has been good or bad,” Copps said.

But Republican Commissioner Robert McDowell said that the report highlights the competitive and innovative nature of the media market. Regulations and policies will only hurt, he argued. “The government should keep its heavy hands off of journalism,” McDowell said.

McDowell stressed that the report is only the beginning of a debate over potential solutions.

The findings contained few surprises in their evaluation of the media market, noting that many traditional news outlets have been decimated by economic challenges and shifting technology.

Governor Signs Long-awaited Bill to Overhaul Adult Education

The following is an update on HB 1340 regarding adult education in Indiana:

Summary: Moves career and technical education to the Department of the Education (DOE) and assigns oversight to the State Board of Education. Moves adult education to the Department of Workforce Development (DWD) and assigns oversight to the State Workforce Innovation Council (SWIC). Assigns to the SWIC responsibility for the GED diploma program and the planning and implementation of postsecondary career and technical education.

Chamber Position: Support

Status: Signed into law by Governor Mitch Daniels on April 1; effective immediately.

Update/Chamber Action: The issues addressed in this bill have been discussed, in one way or another, for most of the last decade. The specific proposals were highlighted in a set of policy recommendations commissioned in 2009 by the Indiana Chamber Foundation and adopted subsequently by a bipartisan legislative study committee. Yet, until this year, the proposal could not even get a vote in both houses. So it’s a real mark of progress that the votes this year were unanimous and that the bill was one of the first to reach the governor’s desk.

Much of the credit for this success goes to the staff at DWD. They began laying the groundwork several months ago and helped demonstrate to both legislators and adult education providers, who previously had opposed these proposals fiercely, that the overhaul would be a positive development. The Indiana Chamber is proud to have helped in raising these issues and in ushering this bill through the Legislature. We’re also looking forward to our continued work with DWD to implement this overhaul and to realize the promising opportunities to better serve Indiana’s adult learners.

Booker on Budgets, Being Mayoral

Up-and-coming political star and Mayor of Newark, N.J. Cory Booker, whose first campaign was documented in the entertaining documentary "Street Fight," recently sat down for a Q&A with Huffington Post. He offered some interesting thoughts on what it’s like to run a city in today’s America, and the challenges facing leaders in terms of both budget cuts and communication:

HuffPost: A trailer for the new season of Brick City starts with a quote from you, on the screen, where you say, "Squeeze everything else but police and fire." But late last year, the city laid off 164 officers, about 13 percent of the force. How did it come to that?

Booker: Look, budgets across the country — 60 percent of American cities have had reductions in their forces of public safety. And, so, this is not something that’s unique to Newark. In fact, right now it’s plaguing major cities in New Jersey. Camden has had major layoffs. Paterson is facing layoffs. Atlantic City. Jersey City. We’re facing, literally, the worst economy of our lifetimes.

So, we have dramatic losses in revenue. And public safety, frankly — police and fire — make up the significant majority of our budget. We were squeezing and starving every other area of our city. Furloughing employees, cutting staff. But it came to a point where we couldn’t cut enough to make up for the tremendous budgetary shortfall.

Challenges demand creativity. I’m grateful that the police director and my team really came forward with a substantive plan to make sure that the loss of those police officers didn’t affect the progress we were making in the street.

And, look, it’s been a difficult adjustment. We had really some challenges in the month of December. But now, as we’re going through January, things are really getting back on track. And I’m really encouraged. Remember, the first three years in office, we led the nation in percentage reduction of shootings and murders. And I’m really confident that now we’re beginning to get back to that nation-leading pace.

HP: I’ve heard that there are the same number of officers patrolling the street. But I also have heard from some of the union officials that in order to accomplish that, older officers have had to be re-deployed: People who were looking at retirement are now on street patrol. Are you concerned about officer safety?

CB: I’m always concerned about officer safety. I think when you are the leader of men and women who put their lives on the line — whether it’s firefighters and police, or national guard members in the military — that’s the most horrific thing, I think, for an executive, when guys who put their lives on the line get hurt or injured.

That’s a concern that hasn’t changed as a result of the layoffs. But in many ways, we have more experienced officers on the streets. Guys with more years under their belts, not people that are six months out of the academy. It’s a give-and-take in many ways.

Look, I’m very happy: We have our chief, who used to be doing other jobs, now in precincts, running our precincts. In many ways, we have the best talent of the agency closer to the street and closer to the ground on a daily basis.

Education in Indiana: Charter School Bill Moves to Full House

The following is an update of a very important bill currently being considered by the Indiana House:

Bill # and Title: SB 1002 – Charter Schools
Authors: Speaker of the House Brian Bosma (R-Indianapolis), Rep. Bob Behning (R-Indianapolis) and Rep. Mary Ann Sullivan (D-Indianapolis)

Summary: Allows private universities and mayors of second-class cities to serve as charter school authorizers. Creates the Indiana Charter School Board to serve as a statewide authorizer.  (Continues authorizing authority for state universities and the Indianapolis mayor.) Makes unused and underutilized public school facilities available for charter school use. Eliminates limits on charter schools approved by the Indianapolis mayor and on virtual charter schools. Increases funding for virtual charter schools from 80% of average state tuition support to 90%. Cancels interest payments on loans from the state that charter schools have acquired as the result of delayed tuition payments. Makes additional changes.

Chamber Position: Support

Status: House Education Committee considered 15 amendments out of 30 that were filed. Three amendments were accepted, including a substantial amendment developed by the co-authors and two additional amendments offered by Democrats. After eight hours of testimony and debate – five hours last week and three additional hours this week – the committee voted 8-5, along party lines, to recommend the bill’s passage. It is now eligible for consideration by the full House.

Update/Chamber Action: Despite the partisan vote from committee members, it certainly cannot be suggested that this bill has not had extensive consideration and debate. Nonetheless, House Democrats offered a Minority Committee report when the committee action was delivered to the full House. That effort failed, but not before a contentious floor debate in which Rep. Greg Porter (D-Indianapolis) and Rep. Pat Bauer (D-South Bend) portrayed the charter bill as an attempt to undermine collective bargaining. (In reality, the bill allows teachers in charter schools to bargain collectively if they so choose; but most charter teachers choose not to join a union.) This bill is likely to draw dozens of proposed amendments and a long, contentious debate as it moves to the full House. The Indiana Chamber will continue working with the bill’s authors and other charter school supporters to analyze amendments, fend off detrimental changes and drive the bill to final passage.  Meanwhile, we are pleased to note the steadfast support of Rep. Sullivan, who was the only Democrat to buck her caucus on the Minority Committee report. We also noted this editorial from Democrat Mayor Tom McDermott of Hammond, who has called for the bill’s passage.

A Few Good Men… in Politics?

Politics is a brutal game. Personal insults. Name-calling. Misrepresenting opponents’ positions. Watching this banter is about the only thing negative about the fall season for many Hoosiers. But a new magazine, The Good Men Project, takes a less cynical stance, recognizing the Top 10 Good Men in American politics. And wouldn’t you know it — two Hoosiers made the list.

"While we don’t expect our list to restore your faith in America’s political system, we do hope to bring your attention to elected officials worth respecting for their integrity, their passion and their ideas," the editors added. "As our political landscape grows ever more polarized — and ordinary Americans feel increasingly alienated from the political process — the conventional wisdom seems to be that when it comes to elected officials, a good man is hard to find. As legendary humorist Kin Hubbard once put it, ‘We’d all love to vote for the best man, but he’s never a candidate."

The proprietors of the Good Men Project Magazine beg to disagree — and they placed two of Kin Hubbard’s fellow Hoosiers on their list to bolster their case. Citing a "need" to believe that there are still good men in public life, they spent months looking for them. Their list is bipartisan, and has its share of surprises. The criteria cited by the magazine in its accompanying article included integrity, intellectual honesty, respect for their political opponents – as well as their constituents – a belief in open government and a willingness to work in a bipartisan fashion. At a premium were men with compelling ideas, along with the political skill to help advance those ideas.

Working our way up the list, the fiscally prudent Mitch Daniels — a former White House budget director who is sometimes mentioned as future GOP presidential material — was cited for his sheer competence in cutting a huge state budget deficit in Indiana, and for doing so humanely and without stirring up much animosity among Democrats — his job approval rating tops 70 percent.

Third Party Candidates Shaking Up Elections

If you’re a moderate or just someone who’s not too enthused about either of the two main political parties, you may find this interesting. According to an article on Stateline, third party candidates are making serious impacts on races around the country. Granted, some of these candidates are former senators and office holders so they’re hardly outsiders, but it is rather noteworthy. (Oh, and the full article also discusses Jesse Ventura, so that alone is worth a few minutes of your time):

In this volatile election year, third-party and independent candidates are making serious bids for governor in a diverse array of states. Most of them won’t get many votes, but a fair number stand to influence the results and it’s possible that at least one may make it into office.

In Rhode Island alone, a handful of independents are running. The most prominent one is former U.S. Senator Lincoln Chafee, who served in Congress as a moderate Republican until his defeat in 2006. Polling has showed Chafee either leading the race for governor or modestly trailing Democratic nominee Frank Caprio.

In Massachusetts, state Treasurer Tim Cahill broke with his Democratic roots to run as an independent against incumbent Democratic Governor Deval Patrick. Recent polls show that he could get as much as 10 percent of the vote, which is greater than Patrick’s current margin over Republican nominee Charles Baker.

In Minnesota, Tom Horner is running under the banner of the Independence Party, the successor to the party once led by Jesse Ventura. Horner, a moderate with a Republican pedigree, is hoping to draw Democrats who see their party’s nominee, former U.S. Senator Mark Dayton, as too liberal, and Republicans who see GOP candidate Tom Emmer as too conservative. Horner has been polling at about 14 percent, which is much more than Dayton’s four-point lead over Emmer.

And in Colorado, former Republican U.S. Representative Tom Tancredo, who has been an outspoken opponent of illegal immigration, may end up outpolling the official Republican nominee, Dan Maes, a Tea Party activist who inherited the nomination after the leading GOP candidate stumbled in a plagiarism scandal. Current polls show Tancredo taking 18 percent of the vote, about the same percentage by which Democrat John Hickenlooper, the mayor of Denver, is leading over Maes.

Given the number of these credible outsider challenges, it seems appropriate to look back at recent third-party governors to see how they fared once they won office, given that they lacked a major-party infrastructure and fellow partisans in the legislature.

Chamber Visits Delegation in D.C.

Approximately 50 members of the Indiana Chamber visited with Indiana’s congressional delegation during the Chamber’s annual D.C. Fly-in event September 14-15. The group, accompanied by Chamber President Kevin Brinegar and other staff, arrived in a city where partisan tensions were ever present and more than a few congressmen were absent, locked in tight re-election fights back in the Hoosier state.

The Chamber delegation visited with both U.S. Sens. Dick Lugar and Evan Bayh, engaging with the latter in an informal Q&A session in the U.S. Capitol’s Visitors Center. Senator Bayh pronounced that it was likely the last time he would be meeting with us as a U.S. senator and further stated that predictions of an active agenda for a post-election “lame duck” session of Congress were overblown. Senator Bayh told the group that there was very little momentum for a broad agenda beyond a fiscal continuing resolution to keep the federal government functioning and perhaps some action on extending the ’01 and ’03 or so-called Bush tax cuts.

Senator Lugar addressed the group during dinner on September 14, joined by Reps. Pete Visclosky, Dan Burton, Steve Buyer (who is retiring) and Mike Pence. The group echoed Sen. Bayh’s assessment about the congressional agenda through year’s end, and tax legislation, the federal budget and the upcoming election were foremost on their minds.

The Chamber participants pressed the delegation on a variety of issues, including pending appropriations bills, reauthorization of the federal surface transportation act and “card check” legislation. Special emphasis was given to extending the tax cuts, as expiration of this tax relief at year’s end would negatively affect the frail national economy and Hoosier small businesses.

On January 1, 2011, Americans will face the biggest tax hike in history. If Congress fails to act, marginal tax rates will increase for every taxpayer, the capital gains rate climbs 33%, and dividend rates jump by as much as 164%. American small businesses, our economic jobs engine, will face marginal tax rates as high as 39.6%. Compounded with the loss of certain itemized deductions and personal exemptions, these small businesses face rates as high as 41.6%. And this increase hits successful small businesses, our job creators, particularly hard: Approximately half of the business income reported on tax returns in 2011 will be subjected to the top two marginal rates.

The Indiana Chamber’s message to the delegation was that outcome is unacceptable and Congress must act before year’s end, but no one in D.C. seems to know when, or if, that debate might occur. In a time of economic uncertainty, raising taxes on businesses and investors would hinder Americans from building individual savings and further investing in the economy.

Extending existing tax rates would, in one bold stroke, boost investor, business and consumer confidence by taking the uncertainty of tax policy off the table. It would leave hard earned income in the hands of the individuals and businesses that earned it and allow them to spur investment, boost consumption, promote economic growth and create jobs.

Now is not the time to increase taxes on all taxpayers, but rather to work together to keep the economy on the road to recovery.

Politics, and the People Who Are Bad At It (an Alabama Story)

Like many politicians in Alabama, mayoral candidate Dorothy Davidson was vying for the endorsement of well-known Univ. of Alabama football coach Nick Saban (likely because he’s known for being a charmer). She wanted to include a photo of her and Saban together, so like any normal person, she figured, "Why not just Photoshop myself on top of a photo of his wife and send it out in a mailer?"

I can’t see what could possibly go wrong here. Al.com has the story:

Bessemer Councilwoman Dorothy Davidson, who is running for mayor of the city, claims she secured Saban’s endorsement of her campaign three weeks ago. Davidson printed it on a color campaign flier that shows her and the coach smiling side by side on a golf course.

But University of Alabama athletics officials on Tuesday said there is no such endorsement. And the photo of Davidson and Saban together is not real, but digitally altered from another photo.

"Coach Saban has not been contacted for a political endorsement of any kind," Associate Athletics Director Jeff Purinton wrote in an e-mail response to questions from The Birmingham News.

Davidson, when contacted about the campaign ad and photo on Tuesday afternoon, at first said the image of her and Saban together was real and taken about three weeks ago. However, when presented later with a 2007 photo of Saban and his wife that appears to be the base photo onto which Davidson’s image was added, the candidate acknowledged that her image was digitally added to the 2007 photo.

Where, Oh Where Are All the Voters?

I am the first to admit that I make my share of mistakes. Just ask my wife, children, friends, co-workers. … You get the picture.

But unlike 79% of eligible Hoosiers who did not take a few minutes to vote on primary Election Day, I did cast my ballot on May 4. And I’ll be there on November 2 when the general election rolls around. More people will decide to be part of the process at that time, but the numbers will still be way lower than what one would expect. People should vote — not because it’s their duty (well, maybe it is), but it’s a right and a privilege to help choose your government representatives. OK, that’s the end of the soapbox.

In this space earlier this month, I was swept up in the 2008 election euphoria (40% turnout due to the Democrat primary battle for president) and predicted 30% or more participation this time around. Didn’t happen. Not even close. The totals sunk back to traditional levels for non-presidential primary years. That is a real shame.

For those looking to be informed now, the Chamber’s IBRG continues to update its election report with results and analysis. In addition, the state released some numbers yesterday. Included in its info:

Data compiled by the Indiana Election Division from post-election reports filed by Indiana’s 92 counties show 21 percent of registered voters cast a ballot in the 2010 primary election. Of those who voted, 11 percent cast an absentee ballot.

Voter turnout for the 2010 primary election was slightly higher than the 2006 primary, when 19 percent of registered voters cast a ballot. In the 2004 primary, voter turnout was 21 percent, and in 2002 was 22 percent. Due to the heavily contested Democratic Presidential primary in 2008, voter turnout was an unprecedented 40 percent.

The newly released figures show a 54 percent increase in absentee voting compared to the 2006 primary election, the most recent primary election with a similar voter turnout to 2010. In this year’s primary 94,671 Hoosiers cast an absentee ballot. Of those, 48,666 voters cast their ballot in person at a county clerk’s office or satellite voting office. The remaining 46,005 ballots were cast by postal mail or by traveling board.

In 2006, 7 percent of Hoosiers cast an absentee ballot in the primary. In the 2004 primary, 6 percent of Hoosiers cast an absentee ballot, and in the 2002 primary, 7 percent of Hoosiers cast an absentee ballot. In 2008, 11 percent of Hoosiers cast an absentee ballot in the primary.
